Proposed Blue Cross Blue Shield Settlement

Clients are receiving postcards and emails informing them of a recently announced proposed national class action settlement.  Information regarding the proposed settlement is also appearing in television, radio, and online ads.


The first question we are receiving from callers has been, "Is this legitimate or is someone just trying to obtain my information?"  

There is a proposed settlement and if you were covered by certain Blue Cross Blue Shield health insurance or administrative services plans between February 2008 and October 2020, you may be a Class Member. 


 The second question - What is this about?  (Please visit site for full description and information.)   The attorneys representing class members (Plaintiffs) allege that the affiliated BCBS Companies (Settling Defendants) violated antitrust laws by entering into an agreement not to compete with each other and to limit competition among themselves in selling health insurance and administrative services for health insurance.  Affiliated BCBS Companies deny all allegations of wrongdoing and assert that their conduct results in lower healthcare costs and greater access to care for their customers. The Court has not decided who is right or wrong. Instead, Plaintiffs and Affiliated Blue Cross Companies have agreed to a Settlement to avoid the risk and cost of further litigation.

 What can you get from the Settlement? 

 No one knows at this point because the amount a claimant may receive is based on the number of respondents that join the lawsuit as class members.  The following numbers do not provide an accurate calculation and are provided for illustrative purposes. 


General Calculations

  • 158,000,000: People covered by Employer sponsored plans. This rough analysis does not include individual plans or ASO plans. (Source: Kaiser Family Foundation)
  • 52,666,667: People covered by a BCBS plan (1 in 3)
  • $2,677,000,000: Total settlement amount
  • $1,900,000,000: Expected approximate distributable settlement (those who submit a valid, timely claim)
  • $146,154,000: Approximate award per year of coverage (13 years)
  • $2.78 - Total award per year / Total people covered per year*

*Assuming all group health plan claimants file, but not considering individual plans or ASO contracts. Adding these elements would further reduce the total award per year per person covered.
